By accessing or using BakedIn's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the new terms.

BakedIn provides AI-powered product recommendation services to licensed cannabis dispensaries, including:

• Intelligent product matching and recommendations
• Conversational commerce interfaces
• Menu integration and management tools
• Analytics and reporting dashboards

Our services are designed for B2B use by licensed cannabis retailers operating in compliance with applicable state and local laws.

Eligibility

• You must be a licensed cannabis dispensary
• You must be at least 21 years of age
• You must provide accurate business information

Account Responsibilities

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• You are responsible for all activity under your account
• Keep your contact information current

Billing

• Subscription fees are billed monthly via ACH debit as specified in your Master Service Agreement
• Payment is processed automatically on the 1st of each billing cycle via authorized ACH transfer
• You authorize recurring ACH debits by completing the ACH Authorization Form during onboarding
• Failed ACH transactions will be retried up to three (3) times over a 10-day period

Late Payment

• Accounts with failed payment after all retry attempts will be contacted by your Customer Success Manager
• Service may be suspended after 30 days of non-payment
• Outstanding balances accrue no interest but must be settled before service restoration

Pricing Changes

Pricing may change with 30 days' written notice. You may cancel before the next billing cycle to avoid new charges. Refunds for partial billing periods are provided at our discretion.

You agree NOT to:

• Use our services for any illegal purpose
• Attempt to reverse engineer our software
• Interfere with the security or integrity of our services
• Resell or redistribute our services without authorization
• Use our services to promote products to minors
• Transmit malicious code or harmful content

BakedIn retains all rights to:

• Our software, algorithms, and AI models
• Our brand, logos, and trademarks
• Documentation and training materials

You retain ownership of your data. By using our services, you grant us a license to process your data as necessary to provide the services.

By You

You may terminate your account at any time by providing written notice. You remain responsible for any outstanding fees.

By Us

We may suspend or terminate your account if:

• You violate these terms
• Your payment is overdue by more than 30 days
• Your cannabis license is revoked or suspended
• Required by law

Effect of Termination

Upon termination, we will provide your data in a standard format upon request within 30 days.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our services are provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees paid in the prior 12 months
• We do not guarantee any specific business outcomes

Some jurisdictions do not allow limitation of liability, so these limits may not apply to you.

These terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in the State of North Carolina. You consent to personal jurisdiction in these courts.
